Hello,
I'm
Malcolm Baker and Dora Wickham knows me quite well. Today I find out
that New Zealand Guardian Trust Limited has not paid my phone bill and
I'm being cut off because of a $400 arreas. Could somebody please
phone them on Monday morning at 07-578-2943 (Craig Roebuck) and find out
what is going on?
In
2000 I invested $160,000 with them, but they have been taking me to the
family court every three years and arguing to the court that I am
incapable of looking after my own finances because I'm mentally
incapacitated. I'm not, but the court has not allowed me to see a
medical report. I have paid them $50,000 since 2000, but now that money
has disappeared, and they say there is no more.
I
have been to see a budget advisor in Tauranga, and can just manage on
my $12,000 invalid's benefit, but they cannot do anything until Guardian
Trust hands the property back to me.
I'm
very angry. They failed to pay the rates and incurred a penalty, now
there will be a telephone reconnection fee. They were appointd to aviod
this situation, and are supposed to be professional. but they think I am
completely on my own and do not know what is going on. I'm legally
powerless to stop them until they put the property back into my control.
I
may be forced to sell one of my sections, (worth $200,000) but I'm
reluctant to do this, and would prefer to budget and improve my income (
and can do this by not payingt their management fee every year.
I
think crooked isn't to strong a word to use, because Craig is a very
smooth talker, but rarely comes up with what he promises in my
experience.
Please please help me because
this situation will only get worse as time passes,

I am sorry but there is little that I can do for you. My suggestion
(and I have talked with Dora Wickham about it) is that you go to Tauranga on
Monday morning first thing and see them directly. My phoning them will not help
as they will not be able to discuss anything with me because of the privacy
laws; you would still have to talk with them directly. Why not email them
whilst you have email still advising them that you will be in there first thing
tomorrow morning and expect to have a face to face conversation.

I
have tried this, and Guardian Trust were going to come out and sign my
property back to me two weeks ago. Nobody is prepared to come with me to
talk to them, so I'm just going to wait things out. It really is not
good enough that the church isn't prepared to support me. This has been
going on for over 14 years, but Guardian Trust think that people who
believe in God should be on medication. I have never been irrational,
but it is difficult to fight on the back foot when people who know you
aren't even prepared to stand up.

I am sorry Malcolm, but your comments are not fair. You asked me to contact Guardian Trust by phone and to talk with them about your affairs. As I correctly said, Guardian Trust would not be allowed to talk to me as they would be breaching your privacy. I am also not qualified to discuss financial affairs as I know nothing about them, I know nothing about Trusts etc so would have to believe everything they said as I would not know what to question.
